Definition: Tax certiorari is a legal proceeding whereby real property owners can seek to have their tax assessments and payments reduced or refunded. The goal of a tax certiorari proceeding is to identify the true market value of the property to obtain tax refunds, exemptions, and abatements.

Eminent Domain/ Condemnation
Under New York eminent domain law, the government has the authority to take private property and use it for public use. The government must fairly compensate the land owner based on market value. However, property owners often accept what is offered to them, even if it is much less than the actual value of the property.
