Sources of Compensation

When involved in a car accident, an injured driver generally has three sources in which to seek compensation:

  • Property damage claim — In order to qualify for a property damage claim for your car, you must be able to prove that the accident was the other driver's fault.
  • No-fault claim — Under a no-fault claim, it is not necessary to prove that the accident was the other driver's fault. Benefits are usually capped at $50,000. unless the applicable policy has Optional Basic Economic Loss Coverage (OBEL) or Additional Personal Injury Protection (APIP) coverage, which increase limits. No fault insurance covers lost wages and medical care up to $50,000. You must apply with the no-fault carrier within 30 days of the accident.
  • Personal injury claim for pain and suffering - To recover compensation for a personal injury, you need to show that you have sustained a "serious injury" as defined by section 5102(d) of the New York Insurance Law.
  • Supplementary Underinsurance Claim (SUM/UM) - If the at fault driver has no insurance, or not enough, your own insurance company may provide you with coverage for pain and suffering.
