James E. Hacker, Esq. of Hacker Murphy, LLP, recently received an arbitration award of over $350,000.00 for his client was injured in motorcycle accident. The accident occurred when the driver in front of the motorcycle stopped short causing the rear-end collision. The client suffered multiple fractures. The Hon. Patrick Monserrate presided over the arbitration which took place in the firm's Latham, New York office.
Since the injured plaintiff was riding on a motorcycle, he was permitted to seek compensation for his medical expenses and lost wages because no-fault insurance did not apply. Prior to the arbitration, the insurance company had refused to offer a six figure settlement.

Interesting, in Europe whoever drives behind is usually considered responsible for an eventual collision, because they're obligated to drive at a certain distance (which is not a fixed number and depends on the situation, so mostly the rear driver's found guilty since the situation could always be viewed differently) away from the vehicle in front. Meaning, if the cyclist is considered at fault for what happened, he shouldn't be able to seek whatever compensation since the accident was not caused due to someone else's negligence..
